I'm wondering this as well. One of the rules of h1b is that the needs "cannot be met by American workers." If you have two people with the same title and one is an American worker and one is h1b, wouldn't it violate the terms of the h1b rules to get rid of the American worker?

It’s a combination of performance and business needs. Corps are money making entities. They don’t care about your immigration status.
Nops. As a manager I don’t remember or know visa status of every member of my team. When I’m asked to cut down on people I along with other managers in my team do it purely on basis of performance and need of skillset for upcoming plans. I honestly never have been instructed by HR to give preference to H1B employees while laying off.

I would say they want the proportion not to suggest discrimination to either side. After all, citizenship and immigration status is a protected condition.
