Last week company lawyers told me my perm was filed. I’ve been told perm processing time is 3-4 months. Once perm is apporved, I-140 process will begin. Do I need to be with Microsoft throughout this process? Please ELI5.
So you’re saying - 3-4 months perm processing. Then they will start i140. And after that is done (X months), wait 6 months more? So I’m locked in for 10+X months? Yikes. Thanks!
You can file I140 in premium, but yes to everything else.
Thanks a lot. You’ve answered my main question. I have 1 more if you don’t mind. Why wait 6 more months after I-140. What’s the purpose of that? Also, if I switch companies in between all this, what is the worst that will happen?
6 months wait is to ensure that previous employer does not revoke your I140. If you change employer , the new employer has to do all this again regardless, ie file perm and I140, it’s just that you will be further late to get in the queue for the GC as you will miss the current opportunity to get it with the current employer
So if it’s more than 180 days after 140, previous employer can’t revoke it?
To clarify, if you join new employer after approved i140 , you will retain the priority date for future , no matter how many employers you switch
You may switch after getting i140 approved. There is a chance that Microsoft would withdraw your i140 application if you leave but most probably they won't and you retain the priority date If you leave after 6 months, you retain the priority date irrespective.
In the exactly same boat!!
For the people from Microsoft - in which labor market test were you included?
I would suggest to wait for 6 months after getting I140, so that you get a priority date locked in, then even after you change the employer , you would retain the PD
