Leaving out a job from resume for H1b holders.

I changed 2 jobs in the last 1 year. Changed my first job after 3 months due to misaligned role and bad manager. Have been at a startup for the last 9 months but the company seems to be going no where. A recruiter from a FAANG firm reached out to me recently and I wanted to apply there. I was thinking of not mentioning my last employer on my resume. Is that ok and does that affect H1b in any way?

This is a tricky situation to be in. Because if you get selected you'd have to submit all your approved H-1b petitions to the employer's attorney. Now realize that attorney-client privilege doesn't exist between you and the lawyer because the lawyer represents the firm and not you and in theory, the lawyer can tell the company about your employment history. But in practice, lawyers don't really care as long as you provide them everything they need. If I were you, I'd not disclose it and if caught I'd say "I didn't think the role was aligned to my career goals and hence I omit from my resume"

Yes, in the past the legal teams ask for resumes and other docs separately via a portal. I am assuming they don’t really talk to the hiring manager. So I can submit a different resume to the lawyers and a different one to recruiter. Also I will remove months from my resumes. So instead of saying company A jan2018 to April 2018 and company B may 2018 to Jan 2019 , I will instead say that company B 2018 -2019.
