Hi Everyone! I need your help! What are my options to transfer H1-B? I would love accurate and detailed answers. Here is the timeline- Came to the US on an F1 visa 10 years ago. Got H1- B approx. 5 years ago. Used H1-B for 1.5 years. Quit job and went back to India to start my own firm. It did not work out. I was in India for 11 months. Came back to the US on F1 visa again. (Doing second MBA/MS) How can I transfer my H1-B visa? What are my options? Thanks and appreciate your help! On a side note, will you put your startup on your resume? If not, how are you going to justify the gap?
The Visa question you shall ask to an attorney who deals with immigration stuff. Most attorneys provide free 30mins consultation. Dont rely on blind folks to guide you through it. For the second one, I think you should put it on the resume even if it wasn't a success. No matter what HR will ask you for the gap so you might as well showcase and be prepared for it.
To the best of my knowledge you can reuse your H1 since you've returned within 6 years of initial approval. In case you also had an approved I140, you wouldn't need to go through the lottery irrespective of time spent outside.
Find a job, they will apply for cos. If you love “accurate and detailed answers”, talk to an immigration lawyer, not people on blind.
