Options while being laid off on H1b

any H1 folks who were laid off recently can you suggest how much time (beyond the 60 days grace) you really have for staying in the US and finding a job? are there any ways (change of status to B1/B2) through which i can extend my stay further to find a new job? getting new job in 2 months looks very difficult in current scenarios. i dont have option to move to H4 but my I94 is valid for another 2 years plus employer gives 9 weeks severance in the form of regular pay checks. offcourse i will contact a lawyer for appropriate advice when the time is right. Currently i just want to see what options i might have based on other people’s experiences please share your experiences

I’m in RF generally coding is not needed. I don’t think I will have the time to move to software while I’m laid off. I will have to focus on roles where it is easier to get in based on my experience . Also unlike IT, telecom is not very H1 friendly.. att and Verizon don’t sponsor so that eliminates a lot of job where I’m a good fit

For what it's worth, you'll be "out of status" after the 60d (technically immediately), but not "unlawfully present", until your i94 expires. Now, what I don't know is what difference would it make to the reviewer of your next H1b (assuming you've worked less than 6y so far on H1b) if you're within the 60d or not. I've read people on Blind who were approved after the 60d. With your generous 9 weeks of severance you actually have a total of 4.5 months to get a job before raising suspicion. That should be more than enough. The 60d starts counting only after you stop being on a payroll.

Out of status is the same as being unlawfully present. 60 days after termination he starts accruing unlawful presence

Absolutely wrong. Out of status is nothing like being unlawfully present. Out of status means you're out of status, but within your i94. Unlawfully present means you're past your i94. The penalties and repercussions are extremely different for the two cases.

There is a confusion on when 60 days starts. Our attorney says it starts when there is no work to be done.

60 days starts with your last date of employment. Been through layoff recently. I would suggest best way is to find another job all other options are a bit tricky and unpredictable.

Nah, now at Microsoft. This was earlier
