PERM towards end of H1-B fifth year

Hi, I'm currently approaching the end of my fifth year of H1-B stay in a month. So far I have not had any PERM application filed. I'm starting my PERM application now. I'm really concerned about whether it'll go through in time. If anyone has been in this situation, it would be great if you can share your experience with me! Thanks!

You still have a whole year. Ask your employer to file your I-140 via premium processing. Pay the premium processing fee yourself if they don’t agree to pay for it. Depending on your immigration attorneys, the whole process should take a few months.

I am almost in the same boat. If you will start in next month or so, you should be fine. I agree with John McPee that I140 in premium processing will help a lot.

One of my friends is at Vmware and his PERM and i140 process got completed within 8/9 months. PERM filed - July 2017 I140 filer - January 2018 (Premium processing)

Why did VMware not file your PERM earlier ? I have seen my new grad friends at VMware having their PERM files on day 1

For me, it took 2.5 years to get an approved PERM. 1 year for incompetent lawyers to finally submit the paperwork and then 18 months for the government (due to random audit). Luckily audit timeline is a bit faster now, but if you have slow lawyers you could be really tight.

I cannot comment on the time taken, its v case to case basis, though there is some hope, if you reclaim time on ur h1b, for all the times u were out of the country, might give u some buffer, might help your case.
