Here's my current situation: Current Visa Status: OPT STEM (EAD expires early 2023 - just one more lottery try left in 2022) H1-B Status: Petition got picked in 3rd lottery last week Employment status: Put in PIP. Need to choose an option of taking severance vs improve at Amazon by coming Wednesday Mental health status: Not good. Was personally having some mental health issues. On top of that, I have been stressed out with the cut-throat culture here; was constantly under the pressure of losing my job and underperforming because of it. Each 1:1 with my manager was adding chaos to my mind. It finally bit me, put in PIP directly without any focus/dev plan Interviewing status: Bombed 3 phone screens till now. Not getting time to lc or prep for interviews. Have a few coming up in the next weeks but low in confidence Yup. This is how it is. Not sure what steps to take next Should have taken FMLA before but wasn't aware of such an option. Not sure if I can take it now with me put in PIP. Will be talking to HRBP Any of you had experiences with FMLA after put into PIP? Can Amazon terminate my employment while I'm on FMLA? @blindcommunity Any suggestions? Any response would be helpful. Yes, if you qualify per federal law, you can always take FMLA at any point before termination. If you take it for 12 weeks or less, with a plan to return, they're not allowed to terminate.
Yes this is correct. I am currently on FMLA and I filed for it the day I found out that my pivot decision was fail. I went through the entire thing before taking FMLA. Now when I go back I will be given a few days to appeal my decision.
OP, when will Amazon file your H1B? The moment its filed and approved, you become cap exempt and can transfer out. Will Amazon stop H1B due to PIP? Will they stop H1B due to FMLA? If they wont, have them file H1B, take FMLA and keep LCing on the side. Ask Blind people for referrals. Target GS, Walmart and Sam's Club, Quicken Loans, Nordstrom. Just get a job. They should interview due to amazon tag, dont worry about prestige and all, just get a job.
It didn't file yet. My assigned attorneys are still reviewing my application. Confirmed that the filing will be done nevertheless. Hmm I need to confirm if taking FMLA would affect my H1 filing. I was thinking of the same thing. Have recruiters who reached out. Haven't given them dates yet. But because of this stress I don't get much time to prepare. Thanks for the questions and suggestions. Oh, didn't think about this point. Thanks for posting will keep this in mind I've already uploaded my pay stubs until November. I hope they file it soon so that I might not have to upload any of this or other documents
Hey, I just went through this hell. In my case my pivot tasks looked doable so I gave it my all for 5 weeks. Worked non-stop including weekends. In the end manager gave some BS reasons to fail even though I completed everything. I filed for FMLA the same day I got my result. Took a few days updated resume and now I have interviews lined up. I would say don't stress there's a lot of time on hand. Pivot 4-5 weeks + FMLA 12 weeks + appeal process 2 weeks. I really hope your H1b is approved in that time frame though. You can still appeal when you come back; my manager did the same thing. BTW, did you get 5 weeks including the decision week? Or just 4 weeks apart from the decision week?
Thanks for your response. Yeah in my case I don't think the goals are doable. I wasn't even put in focus first. Directly into pivot plan. I found out that if we file for FMLA, the pivot would be paused and will resume once we get back. And the due date would be adjusted accordingly. Was that the case for you? In your case were you given 2 weeks of appeal time after you were back from FMLA? Sorry I didn't get the part of "don't stress there's a lot of time on hand" can you please rephrase that?

Take FMLA for 12 weeks close to PIp evaluation to buy time to get in better health n interview at other places.. they can’t ask you to leave while u r on FMLA
You can still take it after failing Pivot before you do a Pivot Appeal. Probably the best time to take it. Probably the best time to take FMLA is during Decision Week, during 3-day you're allowed to decide whether to appeal, or during the 5-day to write the Appeal document. Probably can take it up to the appeal day, TBH. Wouldn't push it that far. Severance is BS. Don't ignore your pay when looking at those numbers.
Don't take the severance. Keep applying and prepping hard and switch to a new company while you have your visa
