Hi Blind fam, I have a question to you all. My PERM is currently in process and I should be able to get I-140 with PD 9/2022 in the next 2-3 months (will apply for premium processing for faster I-140 approval) Now my question is - I talked to multiple lawyers and they mentioned I am eligible for EB2 NIW and EB1 visas as well. My country of birth is India. If I go ahead and apply for EB2-NIW and EB1 I-140 and suppose I get I-140 at three different time periods A/B/C with a priority date 5/2023, then can I change it to 9/2022 PD after my PERM EB-2 #workvisa #workvisa approved (under the assumption, I will get EB1 before EB2) The reason I am asking is because even EB1 has a longer wait time for Indians and I did rather wait 2-3 months and apply for EB1 than applying now and stuck with 5/2023 PD. Not sure what your question is. Whichever I-140 you apply first, that’s your priority date. Priority date can be ported. So for example, your EB2/PERM priority date can port over to Eb1. In your case, best is you apply right away with EB1 premium processing (you will know the result within 15 calendar days).
I have a priority date of 09-Jan-2023 in eb2, and I have heard it may never be current (born in India). If I were to switch to Eb1, is the wait considerably less? If so, by how much?
How many papers and citations you have?
How come you speak with multiple lawyers? Doesn't your company just provide you with one, or do you have to find lawyers yourself?
Op could have hired/consulted lawyers out of pocket or used the law plan from benefits.
I don’t think it matters which one is approved first. You share the priority date among all categories. Once your EB2 gets approved. You can link your approved Eb1 to your “new” EB2 date (which is your PD-1)

And a word of advice: never wait on anything GC related. Just go ahead with your application. You can submit multiple times if you are concerned you might get denied the first time.
