Question for Canadians in the states

Are you on TN air H1B1. When you apply to the states you still have to check off the “need sponsorship” box right? Even for TN?

I used to be on TN. AMA.

How was life on TN? You are just basically tied to your employer right?

Wells Fargo djUQ40 Mar 30, 2019

Yes, but switching jobs is trivial. You just have to cross the border again with your new paperwork. There’s always the chance that they’ll reject your new paperwork though.

Yeah you gotta tick that box

Yea that’s what I thought :/

Was TN, GC now, via employment. I switched primarily because spouse can't work on TD. Got locked in the country for a year because you can't travel on TN with a GC application filed but that was faster than waiting for an h1b.

Oh interesting... so if I had a TN with an American company let’s say amazon. I would not be able to leave the country with a GC application filed. So I couldn’t go home for Christmas? Or certain holidays?

The recommended approach is to switch from TN to h1b and then file GC. If you do that you don't get any travel restriction like that, but who knows how long it will take to win the lottery. On the other hand you can stay on TN indefinitely so you can wait. But on TN spouse can't work so to speed it up you can go directly from TN to GC, but then you get stuck in the country. Maybe not quite a year, but most of it. Maybe have your family visit you in the US for that particular Christmas, that's what I did.
