Report civil surgeon of malpractice

We recently had to go through an ordeal with a Dr. in the Bay Area. Here is the summary - Both my partner and I had to take an immigration medical exam. Due to a rush for immigration medical exams we couldn’t go to our usual places - Stanford / Sutter. We went through the list provided by USCIS, and setup an appointment with the first Dr. with an availability. During our appointment this Dr. they injected us with 3 shots each without providing any info. about the shots. One of us pressed the Dr. to share what we were being injected with and their response was that it won’t hurt much. Next, before the final application was sealed, we asked the Dr. to provide us with copies of the application. We reminded the Dr. this was USCIS guideline and that they should comply with it. However, they became belligerent and tried to intimidate us. We didn’t budge and continued to ask them to follow guidelines. They threatened to call the cops and bring their attorneys. At this point we didn’t want them to represent us in any form, and asked them to give back our documents. After some back and forth it became clear to me that the only way to get the documents back was to succumb to their demands and be on our way with the sealed documents. We opened our documents as soon as we got them to see what we had been injected with. They were some vaccines. And as per law, the Dr. is supposed to provide us with Vaccine Information Statements before administering them. I want to find out if someone on Blind has gone through a similar experience and filed a complaint against the Dr. with California State Medical board. We are ready to file a complaint. But, because we are on a work visa, want to find out what this journey could look like. This Dr. already has a public reprimand by the attorney general / california medical board for negligence. Their Yelp rating is 1.5 based on 50 or so reviews - and yes, we made a big mistake not vetting her on Yelp. Appreciate any suggestions. YOE: 10 TC: 400k

Why you don't want to name the doctor?

LinkedIn hihelo OP Oct 10, 2020

I’m not sure, but afraid if they can sue me for defamation or doxing. Someone is not guilty until proven guilty, right?

Ironclad #TC Oct 10, 2020

This is anonymous. How can they sue you?

Snapchat FatBilbo Oct 10, 2020

lol I mean if you wanna report do it what’s the problem? I hope it is clear for you that you won’t get any benefits out of this process, only pain in the ass so if you have nothing else to do in your life, then go and complain

LinkedIn hihelo OP Oct 10, 2020

Not sure what you are finding funny here. The reason we want to complain is so that she doesn’t take advantage of others in our shoes. This Dr. is preying on the vulnerable, who are anxious for their green card and may find the medical exam a make or break situation.

How hard is it to tell no and walk out? Why would you let someone inject something which you aren’t even aware of? Did you atleast search what those vaccines are meant for?

LinkedIn hihelo OP Oct 10, 2020

We were made to pay $1050 before seeing the Dr. And, I’ve visited Dr’s in the past and they’ve always explained what they are doing. Also, this one was an immigration exam, so I thought this may be protocol. Honestly, there was a bit of vulnerability as I felt this could make or break my green card application. Obviously, this anxiety was a bit irrational. But, this Dr. is preying on this exact anxiety.

Sorry man. Does getting these vaccine or injections part of immigration process? I remember taking few vaccines before entering US for first time.

You’ll have to sue and prove damages.

USCIS requires flu shots if your interview falls on certain month. Since I have been seeing flu shots banners all of the place I believe it's that time. They only exception is for religious reasons and others. Very hard to get in the exception list. If your doc just gave you flu shots then it was an requirement although of course they should have give you disclosures. You should have done the homework before selecting a doc for something so important.

You know you can refuse an injection, right? Why didn’t you say, “I’m not accepting an injection until I know exactly what it is and why you’re giving it to me.” I once got a shot when I was traveling abroad. There was a language barrier and the doctor just whipped out the needle. I physically moved away until he understood that I wanted to know what it was and that he needed to explain it to me.

So they injected vaccines, that’s correct. What else are you expecting?

Microsoft damned Oct 24, 2020

Totally not normal. When we did ours they emailed us a copy before the sealed envelope arrived. They also told us (verbally) before injecting each one what this is. Also written in the doc they sent. And that with me thinking the place was shady! Thank you for reporting OP so that others don't fall victim. Ignore the selfish a*holes here who do not understand the concept of taking care of otbers.

I agree it was unprofessional and bad experience and I’m glad you want to report it if you think there was a law violation. But what has it got anything to do with you being on a visa is not clear. 🙄 And why are you asking this on Blind and not a medical malpractice lawyer?
