Hey all, I have joined current employer few months back and I am going back home on medical leave for ~2 months. I plan to resign from my cureent employer while I am on medical leave and join new employer immediately upon arrival to US again. Update: I am on H1-B visa and I already have approval I-797 from my future to be employer. Can i do that ? what are the implications ? TC: 230K
That's unprofessional AF. But sure do it. It's a small world and expect karma to come back at some point.
True. Small world.
How is it unprofessional to quit a job? It’s at-will employment and nothing more than a business transaction that is coming to an end.
Check your company policy and your employment contract first, if not already done. It may says things like “cannot quit within a few weeks of medical leave without penalties...” Second can ask local employment lawyer re: local rules, if not already done. Some lawyers give a free consultation that you can avail. Third, confide in a known HR associate with your medical emergency. This should be a last resort as things tend to leak, and under condition of “I am considering moving because of.. “ <insert legitimate medically related reason>
Is there such thing like “you cannot resign while on medical leave” ?
You know it’s wrong or you wouldn’t be asking
I assume you are not on any visa. Are you?
I am on h1-b visa.
