Is it possible to legally work in the US on a E-2/H1-B visa and at the same time have a startup in a different country?
Yes. But you will need to declare your income from the other country (if any) in US income tax returns.
For the H-1B, my understanding is that any work done on US soil must be for the employer hosting your visa. There’s been conflicting opinions online (a bunch on Quora) so I’d appreciate if someone has a concrete answer on this

Yes, as long as you don't do any actual work on the startup while in the US. You can be a passive investor in the startup while in the US and you can actively work on it while outside the US.
