With new amendments in S386 everyone should be eligible to file for EAD. For all intrinsic purpose this gives benefits equivalent to green card except early path to citizenship. @ROW this sounds win win to me, what's your reason for still opposing this bill?
More details please, may be a summary of new amendments. Lazy to read the new amendments.
copied from another post ============ First, it would better protect immigrants and their families who are stuck in the employment-based immigrant visa backlog by allowing immigrant workers and their immediate family members to be eligible for āearly filingā for their green cards. Immigrant workers would not receive their green cards early, but they would be able to switch jobs and travel without losing immigration status. The amendment also protects the children of immigrant workers from āaging outā of green-card eligibility so they would not face deportation while they are waiting for a green card. Second, the amendment would reserve 4,600 green cards on an annual basis for dependent family members and new immigrant workers who are stuck overseas and would not not be eligible for early filing. This number is based on the approximate number of people who apply for employment green cards from overseas each year who are not otherwise accounted for in the bill. Finally, the amendment would address abuse of H-1B temporary work visas by prohibiting a company from hiring additional H-1B workers if the companyās workforce has more than 50 employees and more than 50 percent temporary workers. This commonsense bipartisan reform would stop outsourcing firms from abusing the H-1B visa to exploit immigrant workers and offshore American jobs.
*āImmigrant workers would not receive their green cards early, but they can apply i485 upon i140 approval, which grants them i485 EAD until they get green card. EAD would be able to for applicants to switch jobs and travel without losing immigration status.ā
I did not read the bill but, even as a H1 holder myself, I feel this seems too unlikely to be true. Isnāt the whole purpose of H1B is to guarantee special occupancy, to prevent us taking jobs from American citizens? They really cool with us start driving Uber, being Starbuck Barista, doing vlog, and launching a bunch of contracts in our spare time?
With EAD I think you are eligible for same or similar jobs only.
Unless it gives freedom from not getting kicked out in 60 days without job or doing job that's different from their field, this is no good.
EAD could definitely grant you the latter...
So someone who has h1 ead can be employed as janitor so that they don't lose status?
For itās only a lie
?
Where did you see this update?

When will be the next vote?
Do you understand, that this will never pass Trump?
Why? He supports legal immigration reforms right
Lol. No, wrong. His base do not support any immigration.
Sen. Durbin (D-IL) and Sen. Lee (R-UT) discussedĀ S.386 on the Senate floorĀ and postponed the unanimous consent vote.
Why are Indians so much in support of it when they intrinsically are against minorities as evident through cab+nrc? Choose a side guys
Now that you cant come up with good reason to oppose it, you are bringing up completely unrelated points wrt discussion in hand, well you still get applause for participation.
I read that these EADs have some conditions under AC21 so you can only apply for jobs for the same job code. You can't drive Uber etc. (not a lawyer so DYOR)
Then thatās not a real EAD. EAD shouldnāt have any restraint on types of occupation as it is not employment based. Itās originally one of the benefit from GC. This bill is just to let applicants get this benefit earlier.
Yeah, I'm not sure how true it is but I don't really mind that (as a backlogged indian ofcourse. It's still a negative for ROW). As long as a layoff doesn't mean getting deported and being able to travel in and out of the country at will, it'll improve my life a lot more. Also since people on this EAD can switch jobs with approvals it should help reduce artificial wage suppression as well.
Dumb Q : How is it equivalent to GC?
It's not. Maybe for OP it is.
Not saying itās right but for a H1B holder it does take a big step closer toward GC. EAD literally eliminates the SO restriction, which is the biggest disadvantage for H1 visa. It means you can do whatever and how many number of jobs you want. Of course we still do not enjoy social welfare and other benefits but I donāt think we are here for that in the first place.
