I am seriously considering taking the EB1C route by transferring to London office for a year and coming back on H1B(or L1A if lawyers are confident) and port from Eb2 to Eb1c. Though i dont have direct reports but manage the core functionality of my IT infrastructure and a bridge between multiple departments. My employer has zero experience with L1A visa and just want to play it safe. from their perspective, they want to avoid me losing L1A(which adds permanent record of visa rejection) and/or any audit by USCIS. Obviously, i am not asking to falsify my credntials but they dont see it the same way. Disclaimer: All those who just come here to pee about how much you hate this, pls channel your anger elsewhere. Read enough and there’s nothing new you’ll say that makes any difference. questions: (for those who have been thru this) 1) My title doesnt say manager but i pseudo manage various teams members. Does that pose higher risk in applying for EB1C? 2) My firm’s attorney is Fragomen and I havent had issues in last 10years with H1B extention etc: How are they in terms of working on EB1C? 3) My current H1B is valid for another 2.5years. so is it possible to spend 1year of it in London and come back on same visa? If yes, then can i still submit PERM for eb1c using H1 onstead of L1? My motivation mainly stems from being able to switch careers and start a business. i dont want to do this 9-6 grind. 1. Better to be some sort of manager . Atleast in the petition that they file ( uscis has few of their own titles, attorneys can fit u if it’s possible 2. Have different opinions from people . U don’t have a choice anyways 3. Yes you can

No don’t do this . 1. If you get an RFE you will be stuck outside the country.If your visa gets denied you may not be able to return. It’s a matter of documentation yes but you never know. 2.You don’t have a choice -fragomen and BAL are the two major players and both depend on the individual lawyers 3. This is possible -you will still be on H1 status so you can use that to come back ; however if you get an RFE or something goes wrong your return will get delayed and then your H1 may end-however you can use your I140 to return. I would say : If your satisfied with how much you have earned then take a chance and go to London and move back.But make sure your getting close to your US comp in London so you don’t lose that while your waiting there
I don’t get why I would be stuck outside. I have a valid H1B and I-140 with EB2 PD. If I get RFE for EB1C PERM app, my old I-140 is still valid and can be used to extend visa right?! So it’s just a roll of dice to see if EB1C port succeeds. I understand that the RFEs drag for a while but that shouldn’t affect my H1B extension using existing I-140. Pls correct me if I am wrong. (Of course I will check with attorney but I assume this is common knowledge)
When you use your I140 to extend your visa you will still have to file for a new visa. Every new extension is technically a “new” H1 visa.Your RFE has a good chance of clearing after a few months BUT the probability of getting an RFE is still around 50%.(or 40% at least-check the USCIS website for latest numbers ) Basically even extensions with the same employer ,same manager and same Job profiles get RFEs these days.
Atleast right now your only problem is not gettting GC in your lifetime, however if there is even a slight issue with your L1 visa, you will be stuck in a country you know nothing about with all your life, friends and assets stuck here. All in all, you whole life will be at mercy on the mood of the bachelor degree holder consular officer. All the best!

And usually look down on a person who didn't waste their time 2 years on a stupid degree. Your title doesn’t say manager, you don’t have direct reports and you’re a “bridge between multiple depts” (whatever that means) You just listed 3 legit reasons why you straight out don’t qualify for the L1A. Don’t try to circumvent the system - stick to your H1B and pray to Jesus you get your GC in this lifetime.

Lovely! In case it is not clear I used to manage the entire backend infrastructure and bridge between trading and two IT departments. I chose not to have direct reports as I was delegating all the tasks to team heads of Other teams. I would layout high level architecture , implement POC and thereafter delegate the rest. It’s fairly easy to throw some Junior Engineers under my supervision. And from the looks of it I guess that’s what I should do next. Anyway, thanks for making that clear. PS: I don’t believe in praying to get something.
You’re not a manager, you have no direct reports... basically what you’re contemplating is outright fraud.

Jeez. Read above posts before blindly commenting. How is it fraud if I just meet all the eligibility criteria? What’s the fuck about title? I have clearly mentioned, getting some junior engineers under my supervision is something I chose not to do up until now but now it just comes without asking. And did I mention all of them are Americans making 150-180k?! I have 13yoe working for American companies and have a fair professional reputation. Anyways, I just mentioned this to my manager today and he’s onboard and will assist with the process. And I have a call with Fragomen next week to discuss the options. And some of them are the ones who went thru the same situation and somehow succeeded in getting thru the other side. Just trying to give some perspective. Take it or leave it.

Following this post. And I hope it works for you. To my knowledge 1. It could warrant an RFE easily if the title doesn't say that especially because USCIS gives them out to many cases 2. They shouldn't be a problem but they try to avoid filing for EB1 unless the case is strong 3. Not sure but I think your H1B is not invalidated with you working elsewhere.
Thanks! Has anyone here got RFE and got thru the process.? Is it just a matter of extra evidence of work? Again from experience, how long have has it taken for each case with RFE typically once you submit it?
