Please be gentle. :P I'm currently going through the IP agreement with Shopify and there's a non-competing clause saying I can't work in any company in the same business as Shopify. When I reached out to their HR, they're saying any tech company is considered to be in the same business as Shopify. Does this mean even if I get an offer from places FB or Google I can't take it? Just not worth hassle and not recognised most places like Cali. Also most firms will only even try to apply in very niche areas (e.g. high frequency trading) for very senior people. Usually you get paid your full base to do nothing if that is asked

OP have it read by a lawyer before signing. Are you in CA? Non-competes are prohibited in CA which makes in unenforceable but also the company might be in violation to put non-compete clause if it's in CA (don't know about other states). Also, ask them to remove that clause? Friend of mine was in a similar situation told he wasn't comfortable signing it like it was and eventually had it removed.

Non competes in Canada are rarely enforceable. It matters way more when executive/technical executive level leaves to start or join a direct competitor in the very same space.

Ya non competes aren't enforceable in Canada also believe they've been shot down the us too. In pretty surprised they do this. Can you post the text of it?
Can someone provide insights into if non compete at shopify is negotiable? I am aware that in California this cant be enforced but I am not in california so need insights . What about other US states ?
