Should I pay back $8500 overpayment to previous employer?

Worked at JP Morgan Chase. When I left they paid out vacation days but overpaid by $8500. Now they’re sending emails asking to pay it back. I spoke to some internet lawyers they said pay it back or face lawsuit. I spoke to JP Morgan payroll, they said they wouldn’t take me to court but would mark me as a no for rehire. So only risk seems to be marked as no hire for future and no lawsuit. I don’t plan on ever going back to JP Morgan Chase.

If it's money you didn't earn, give it back. Just because it isn't illegal and you are willing to live with it's repercussions, doesn't mean it's right to do. You also don't want to burn bridges like that. However strongly you feel you will "never go back", you just never know. world is small and who knows what's your situation after 10 years? Would you not regret if you were offered a great role in JP Morgan down the line of your career but your today's decision to burn that bridge prevents you from taking it up?

+1 to this. It is a small world. You are burning a bridge here and blackballing yourself for life. Its not worth the guilt for $8.5k. You will be happier in the long run if you pay it back and will be able to stand tall with pride you did the right thing. This issue could come out of the woodwork at anytime in the future and wreck your life. Being convicted for felony theft (you are way above the $950 limit in California or $1000 in New York) will destroy your ability to work anywhere. Not to mention but stealing like this will blackball you from the banking industry forever. You basically have a bomb sitting under you for life, that you can diffuse for $8.5k and never have to worry about again. Its a small price to pay.
