I have an offer from Etsy, that asks me to share any non-compete documents from previous employers that could impact my ability to work for Etsy. I am currently working at Amazon, and had signed the standard Amazon non-compete: 'For 18 months after the separation date, employee will not directly or indirectly engage in or support the development, manufacture, marketing or sale of any product or service that competes or is intended to compete with any product or service that competes or is intended to compete with any product or service sold, offered or otherwise provided (or intended to be provided) by Amazon, that the employee worked on or supported, or about which Employee obtained or received Confidential information.' I don't think what I was working on at Amazon competes with what I would work on at Etsy. Should I share this non-compete doc with Etsy, and will this impact if I can be hired by Etsy. Should I consult an attorney on this, and if yes, can someone suggest a good attorney? Does anyone have experience with this - I would appreciate any insights you have. Thanks! TC: 300k
Extremely standard NDA language. Unless you're trying to take (any) solution you built while Amazon (that now belongs to Amazon IP) to Etsy this is not a problem. Also unless you're like L10+ at Amazon and potentially have insider knowledge, an NDA wont really be enforceable nor would they pursue it unless you violate the above. Thousands of people leave amazon for other companies all the time, partners and all, not an issue
As a recruiter I can tell you that asking to see your candidate’s signed non compete puts the company (etsy) at liability for prosecution if the candidate’s former company (amazon) decides to sue u for breach of the said non compete when u join the company. That’s literally recruiting 101 on how to keep away employment related lawsuits so I’m surprised why they are even asking you to show your document. But your non compete seems pretty straightforward and standard so it should be okay!
Non compete clause is not enforceable in many states. Just Google it and you will see. If your role is very important then yeah a seek a legal consul. But confidential information is something that you cannot share with your new employer, this is true for all employers actually. Etsy wouldn't want you to share what Amazon is doing or else you would probably be breaking Etsy's policies too!
Many people who join Etsy also keep their Amazon jobs. What are you talking about?
