Hi All, Recently, I got a good offer from Facebook at IC6 level (in Seattle) and decided to accept it. If everything goes well, I will get an O1 visa and my wife O3 (no work right). FB will process GC but it will take a year at least. My wife is also a PhD and now works for KPMG in Australia in a R&D consulting role. The problem is if we move to the US she will have to give up her job at KPMG but she is as capable and ambitious as I am. Probably more. I am feeling guilty that she has to sacrifice her career so that I can build mine and trying to avoid the situation in any way possible. I am sure many of you have been or are in this position. Any advice? Edit: we have a young kid, so living separately is not an option. Update: We’re going for E3 route based on the advice from the lawyer. TC ~ 435,000 YOE 12 #workvisa

How O-1 Visa and GC are connected?
I am in a similar situation. Do you have kids or some other complex factor requiring both of you to be physically together (as a must have)? If not, a year is not a long time, visit each other often, use work from home whenever you can and establish a regular video call schedule. Either of you shouldn’t sacrifice your ambition/career because it’s not fair to both of you. Your partner will probably feel guilty if you don’t take this amazing opportunity. Start separately and then gradually align your career locations.
Yeah, I should have mentioned we have a 3.5y old. So staying separately is not an option. Thanks for the suggestion, it would have worked easily (relatively speaking) otherwise.
If you're getting greencard in a year that would mean you will get your i140 before that. Which means you can sponsor her EAD. Ask her to work remote for sometime. You will have to sacrifice for a year and she can transfer to US. Other option is to get a transfer to US with KPMG. Or interview here with other firms. Talk to a immigration lawyer from US. I will suggest Reddy & Neumann to find out the timeline. They are good. Good thing you're not on H1 or else my answer would have been that you're in a problem. I am not a lawyer. Getting her on a L1A at KPMG with her credentials seem like a feasible option, also a good path to get her GC as well

Stopped at first line. FB has some GC processing issues and it might take more than what you expect. Not sure if that’s applicable to O1. Check that before joining.

Can confirm. All FB perms are blocked currently pending a lawsuit, which may take multiple yrs to resolve. Many GC aspirants are leaving company because of it. Join fb after GC or be prepared to wait few yrs and even risk running out the h1b clock.
O1 sounds big but actually it isn't as big. I have not done anything special beyond getting a PhD and 50 odd publications at good venues. Its mainly the PhD that makes individuals special for the sake of this visa.
Location of PhD matters?
O1 and then GC on EB1 should get you EAD in less than 1 year. So wouldn’t your spouse not working for that short time not an option? However note that in COVID times processing with USCIS is dog slow. So usual timelines may not be applicable.
That's good to know that it won't take as long. Financially, of course, it is okay for her to not work but she has just returned to workforce after maternity break, so her career needs to be supported at any cost.

From what you’ve mentioned, it seems to be a good move (coming to US) for both you and your spouse. So think of it as a short term pain for long term gain. Good luck !
OP, your wife can easily rebuild her career in the US. People take time off for relocation and settling families. Companies understand that. You as a family will need someone to focus on figuring out logistics as well. In a year, she will be able to find similar opportunities. If you want legit info about processing time, please talk to other O1 visa holders about your processing time. Seems like it is a coveted visa. Rules may be very different from H1b and other visa types.

That probably means your GC processing may be quicker. Just so you know, there are people who would die to be in your position. Not trying to patronize.
With your credentials, you should be able to file using NIW. That way you dont have to worry about employer sponsorship.

That will get you a GC without having to deal with Facebook PERM issues. N once you have GC, your wife and of course work.

We are Aussies. So the wait is much less for us than many other nationalities. The estimate we are given is about 1 year from the time of filing.
