My TN Visa grace period is running out Mid-October after layoffs. I have 2 on-sites next week, others the following week. I also have 1 offer from a smaller company I haven't accepted yet. How bad is it if I overstay my Visa by a week or two to ensure I complete all my on-sites and get an offer with a company I want. Then I would leave the country and come back and apply for a new TN.
60 day grace period?
Yea, you get 60 days after loss of employment to find another position or get your affairs in order. This is for the TN Visa for Mexicans and Canadians under NAFTA
Overstay a day and you risk any future TNs being issued, esp in this climate
Leave and come back that's I've heard. But check with a lawyer, your new tn might get denied otherwise.
So come back as a visitor while I continue to interview?
Yes, but you should get real legal advice. It's not THAT expensive
Never overstay in the US. You might get banned from any future visas.
What if I still have all my things here still, will they give me shit about it?
Leave and come back as a visitor. Overstaying can get you banned.
Do you think there will be an issue being a visitor while I still have all my things in the US?
They care more about following rules. The fact that you left before expiry, shows that you respect the laws. The fact that you are honest that you are looking for work (you can "say" that you're looking in both places). Your things being in US were due to unplanned layoff. So even moving and/or selling them will require your time and presence. Remember, their main target is to make sure the laws are followed. The last caveat to look into: visitor visas only allow for 6 months out of a year to be present in US. I don't know if they count TN for that number. Consult a lawyer or the border office.
Yea that sounds like the best way.
U don't need an employer to sponsor TN Visa, right?
I'm not sure if sponsor as it's traditionally used applies here. But you do need to be employed with a TN. If you lose your job you have 60 days to find another one. Then you just show up to the border and get a new TN with the new Employer
Ah I see. So if u don't have employer u can't get TN at border?
