Euro guy married to a US Citizen. Been married for 10 years and have had a Green Card for that entire time. In order to apply for naturalization, I have to have been in the US continueosly for 3 years sice I’m married to a US partner. I’d normally pass that easily, but I lived abroad with my US partner for 13 months during this period. In July it will be 3 years since we got back, so I’m hoping to file the N-400 soon. Am I fine to apply for naturalization since I’ve been back for 3 years? Or is it something else I need to do before I file? Did not file N-470 when we lived abroad. Appreciate any help or suggestion. IIRC you can apply 3 months before you've been here for 3 years.
Did you re-enter the US during those 13 months away? If not I’d assume they gave you shit when you came back, but if not you want a lawyer pronto since you may have problems. If you approached USCIS ahead of the 13 month leave to get permission because your US citizen partner was effectively forcing you to go abroad then they could waive that perhaps. Again get a lawyer if you want to proceed quickly since it could save you money in the long run. Also be aware of any tax stuff you might have not thought about for the time you were away. I have no idea what you do/did but there is all sorts of BS bureaucracy for US people incl green card holders who are working elsewhere, and have any volume of income.
