TL;DR My offer was rescinded by Tesla because the H1B petition requesing transfer domestically failed. The only way is to renew my visa in a third country. The whole process is problematic because I paided the Premium Processs for $1,770 myself to expedite onboarding and Tesla just decided to withdraw the H1B petition without discuss with me. Now I not only lost job but lost money. I felt so humiliated and frustrated going through to whole thing. ---------------------------------------------------------------------------- The Real Story I was laid off this March. It was really difficult time for me since companies started laid off people due to affected by COVID-19. I prepared and interview continuously and finally I got some offers in July and decided to sign the offer with Tesla. My H1B visa was already out of 60 days grace period and I was required to onboard in early September. I have 2 options to handle the visa at that time. 1. Tesla can file my H-1B requesting extension of status and ask USCIS to use its discretion to excuse the delay. If extension fails, I still can use the approved H-1B petition to travel back to my home country to apply for my H-1B visa stamp and return to the U.S. and commence employment with Tesla. 2. Tesla can file my H-1B petition, and I will need to have to apply for H-1B visa stamp in any foreign consulate first and using this approval to return in H-1B status It was reasonable to take option 1 at that time because it is more flexible. I may have a chance just got approved by USCIS and start to work without flighting out. Even though it fails, I can still get visa stamp and come back. (I am not subjected to the Presidential Proclamations and U.S. consulate has already resume full operation in my home country now). The con is it takes more time. Per Tesla policy, they don't pay Premium Process for candidates. My onboarding timeframe was very tight and I have no choice but paying the Premium Process fee myself to expedite my onboarding. However, after USCIS gave a RFE to my case (not even a rejection!), Tesla decides to abandon me immediately and withdraw my H-1B petition without any discussion with me. I was totally shocked! In order to take this offer, I gave up other opportunites and pay the money to expedite the process. Suddenly, I got nothing. I lost job again and lost money. I felt so angry and frustrated. What can I do? Probably nothing. I'm so insignificant in this system and these giant Tech companies can just play games with you and abandom you whenever they find you are not in their business interest. I don't know what to do next. Not many companies willing to support candidates who need H-1B filing through overseas process. Many HRs try to avoid such risks. What sometimes perplexes me is that would someone value or trust USCIS over their careers? If I were as talented as you, I would focus on getting good work elsewhere. I understand that there can be commitments which might hold you back, though if there are none, simply don't waste any further time. Because it's worth more than a piece of paper from USCIS - their loss anyway.

Faamg is much safer for visa than other companies. If I was on visa, I would have interviewed with other faamg (you already got in Fb, so you could have got a faamg offer, especially MS is really easier than others to get in).
