Here is your uber "employee": free to work whenever, wherever, for as long or short time as they want, with no boss, using their own equipment, while freely working for competitors at the same time. Sure doesn't sound like a fucking employee to me.
It's just a way to save your riders from themselves. Uber is paying them slightly above their depreciation costs, without making the aware of the stupid trade they're making. You wouldn't make that trade, I wouldn't, the poor guy with a car who needs cash doesn't. He's essentially selling his car in little pieces to you for it's fair value, while working on top of it. Designating them as employees will allow them to at least get the relevant minimum wage
You actually have to pay a lot more taxes if you have to be an employee so most people actually don’t want to be one, they would rather be a contractor. The government of course wants this so they get more money. It’s a conflict of interest.
How do you reason that? Contractors pay both employer and employee parts of FICA. Additionally cannot be provided certain sets of benefits. It impacts health insurance options. It impact 401k options. You have to provide your own tools for the job. Granted you can deduct things but IME unless you abuse it it rarely pays for itself. I was a contractor for two years despite a 15k dollar raise my total take home including benefits was about 5k less.
I think having the option to be an employee is one thing, but for the ones that don’t want to be, they shouldn’t be forced to. Many consider these “gig” jobs as part time work and already get benefits from spouse/parents. If you have two jobs you have to pay more taxes/benefits. I am just saying NOTHING the government does is to benefit anyone, it’s always to just make more money.

I don't think employee is a good definition, but absolutely agree that earners should have access to health care benefits, pto/sick leave, and unemployment. Making everyone an employee just results in gig companies only hiring 10-15% of people and they get locked into schedules for cost savings. Although the gig companies aren't forced to do it, it's the only way to sustain a profit. This would reduce reliability and increase wait times for users during peak demands while increasing prices and eliminating 80% of the roles. Retain flexibility, ensure minimum payments, pay into health care/sick leave/pto/unemployment insurance plans or fund based on pro rated time on each platform. It's the only logical way forward without ruining a bunch of earners opportunities and simultaneously crushing the gig companies. The gig companies and the people driving/earning on their platform are inextricably intertwined.
I'm pro labor and pro union, and I feel like this even makes sense. I'm not sure what I'm missing? With this type of work, it feels like a different classification. My father in law drives, and he wants the flexibility to go for a couple hours, on his schedule. He considers it a gig, not full time employment. If Prop 22 didn't pass, above is exactly right. He would be given a schedule, and a boss, and that's only if he's one of the small % of people who are accepted after applying and interviewing like any traditional job. Those exist, they are private car services. Also didn't 22 give drivers higher wages, access to insurance, etc? Not full protection as if you were an employee, but it seems like a reasonable trade-off.
Yup, prop 22 gave higher wages, sick leave and health insurance access. Prop 22 on a nationwide level is the only thing that will work. I also think some form of UI should be added.
