A couple months ago, I asked Blinders if I should sue British Airways for refusing to pay a delayed/missed connection flight claim. For those of you unaware, when flying to destinations in Europe, airlines are supposed to pay passengers a fee if they ruin your travel plans with delays of more than 3 hours. British Airways kept us on the ramp after arrival, causing us to miss our connecting flight, and then didn’t rebook us for over 24 hours! They claimed the delay was caused by airport transportation and therefore not their fault. Thanks to Blinder’s input, I sued using an online UK no fee no win legal service. Today I learned my settlement will net us just over 1,000 pounds! Thanks for the input, everyone. 🙏 UPDATE: I used this legal service https://www.bottonline.co.uk
Pay it forward
You didn’t have to use a no win no fee process. There’s a form you fill out that the airline has to make available to you in case of a delay. You probably had your actual payout garnished like 30%
Yep, we did that and appealed 3x’s. British Airways denied the original claim and 3 appeals.
You didn’t sue them. You are confused, unless you did file a lawsuit in court and wasted quite a bit of time and funds. Obligatory compensation due to regulation is not a lawsuit, unless the regulatory body filed suit on your behalf.
We originally filed for the obligatory compensation and appealed 3x’s. British Airways denied the original claim and 3 appeals. That’s when the legal service filed a suit on our behalf.
They sent a intent to sue. Not the same as litigating. British airways then thought it would be cheaper to give you some cash. Note: you'll might have to pay taxes on lawyer fees. That's part of your winnings. Be careful.
Same experience and same excuse transiting the UK. Going through BA directly, they offered $200 as a token of goodwill on $8000 tickets. Can you share a link to where you filed your claim and won?
We used Bott and Co. out of the UK.
A comment from another user: “You should've filed and intent to sue with your claim with British airways. It always works. Unfortunately, this way you have lost over 33% in addition to income taxes that you have to pay. Next time just do it yourself and actually sue them for $4500 in a small claim court. It always works. This way you'll get your money back+taxes+ fee+ time wasted”
Well done. Fuck British Airways
Fuck British
Fuck human
Thanks great Op, good job.
The same is happening to us with Lufthansa, still don't have the money. In our case they just reply "the money is being send" every time we email them. What a way to ignore customer. I wonder if there is any other way to get the compensation without using 3rd party service which takes a cut of the money. I do hope someone will actually sue them eventually for this practice and they will be fined a lot.
You could try contacting the Civil Aviation Authority and see if they can speed up the process. (It sounds like your experience is better in that at least Lufthansa isn’t telling you they refuse to pay).
Lufthansa is a trash airline unfortunately. Not worth the money. Food is not offered or crap. Service is bad. I thought they would be at least punctual but apparently they arent
In USA use fair shake. I got a settlement from a credit card company of $5k.
What was the scenario?
Do you have it's website?
I got 500 from BA
Wish USA had consumer friendly laws for airlines
You want more consumer lawsuits in the US?
Yes
