Posting on behalf of spouse. She is going to complete 6 years on h1b in 2024 October. Her employer started her PERM process in May 2021 but unfortunately it received a PERM audit in Oct 2021. Lawyers responded in Nov 2021. She has been following up with fragomen, and they say the response is still pending. Her initial plan was to get i140 approved and switch jobs after completing 6 months, we were hoping it would be around July 2022. But now we are wondering if it's too late for her to switch jobs in 2022 and apply for PERM with new employer? Her current job is okish, but she is getting paid 🥜 and no growth in sight. She has been grinding LC on weekends and is motivated to leave but, the audit situation has us confused. Should she wait for i140 + 6 months to start interviewing? Depends if the new company can do it on day one. But there is still a risk. Nothing is guaranteed.
