If it is so easy to fix, give some solutions instead of just stating the problem.
Solution 1 : pickup first who weren’t got selected in previous years

You think the system is broken. They don’t think it’s broken. If it’s illegal, they would say so and penalize - perhaps they meant it to be this way.
I am not aware of "last attempt", you can file from outside the US.

Increase the bar for application process. 3 years ago it took 4k$ for a company to submit an application, and the application package should be comprehensive and done by an attorney.
The issue is politics, not inability to design a better system. As long as a big chunk of Americans don't want too many immigrants from certain places, the system will not improve.
The issue is everybody thinks a better system is the one that favors them and don't even realize we already have a better system.
