I had a fight with my spouse and was arrested for a day (domestic violence assault degree 4). My lawyer is arranging an SOC (Stipulated Order of Continuance) agreement with the prosecutor. Essentially, it says that I must attend counseling classes for a year, and the case will be dismissed after a probationary period. I have no past history of any arrest or conviction. As I work in AWS and an annual background check is coming up soon. Will Amazon terminate my employment due to pending criminal charges? I'm in WA state. I really want to hear from someone who has gone through this or knows someone who went through similar situation. PS. Cross-posted from the Amazon company channel.

Annual background checks are intrusive (akin to spying on your neighbor). Does Amazon have a good justification for doing an annual background check? Are they doing national security work? Are the employees working with vulnerable people such as young children? If the answer is no and we are talking about an isolated case ... let the courts penalize the offender (that is the court's job) and the companies should stay out of it. If and only if the court arrives at the conclusion that the individual poses a threat to co-workers or company , then and only then the courts could decide to notify the company. But honestly... the truth is background checks have become common place (even when not needed/not justified) for 2 simple reasons: 1. Companies make too much money and have too much power in the law and power over people who need jobs (employer's market). 2. Background check have become very cheap, easily accessible (order online) and even automatable. So why would a company not do background checks. It's soooo easy and cheap that every company should and could be doing checks every 6 months, for no good reason... just because you can use the info to fire the bottom 10% as most companies do
What about background checks while starting the job? You can use the same logic there.
