Because foreigners already have this job, the idea of a PERM certification is to “prove” that you can’t fill the job with a citizen or green card worker so they can apply for a green card for the worker. Except that tech companies now go out of their way to ensure that they have difficulty filling those jobs so they can tell USCIS that they couldn’t find citizens and they need to keep the visa guest worker. Making people apply on paper was one of the ways to make it difficult. But I bet if they truly looked hard enough they could find qualified citizens or GC holders.
Yep. This ^ For companies that do post ‘PERM applicants’ jobs. They’re not actually looking for a US Citizen or GC holder to be a viable candidate for the role. They are just trying to check a box to get the PERM application through. You will see posted jobs written as buzzword gibberish with no clearly defined role/responsibilities. Even if a citizen/GC holder did apply, companies scrutinize the application to find any tiny thing to deem the candidate to be unqualified. When companies follow the process of posting the ‘PERM applicants’ job, the cost falls on the Citizens and GC Holder who spend time on applying to these roles in their job search (when in reality there is zero chance of an outside hire).

Job advertising part of PERM is such a farce. I’m sure there are viable citizen candidates for every position. Companies just can’t find them fast enough. Having to prove there are none is pointless. I think showing a history of open headcount and continuing hiring process is a proof on its own that company cannot fill all the positions they want.

The person for whom the company is applying has been doing the job for 2+ years. That's worth 100x more in terms of determining who's qualified as opposed to some idiotic interview process. So it's the regulation that's completely stupid. Apple decided to pay some moronic bureaucrats without real jobs $25 million as a nuisance settlement. PS: I'm a citizen since birth.
