I'm thinking of going back to India and working from there for 3-4 months. My team is cool with it, as long as I'm available during US work hours. (It's quite beneficial financially as well). My Visa is stamped for the next two years. So I don't need to visit the embassy at any point. I was wondering if anybody else is doing the same. Is it fine to stay out of US for this long? Does it affect H1B or green card? (I've heard that tax issues start coming up but only after six month from what I've researched). I hope immigration won't create any trouble on my way back. #h1b #wfh #workvisa

Your friend has been working from India for Intuit? What company does he work for?
Wasn't there a blind post a month or so ago where someone was saying that they went to India for working remotely and ended up getting fired for it once they found out about it? I can't remember exact company but I remember it being one of BOA or AMEX or jp Morgan. Just because your team is ok with it, don't jump the gun based on it - they may not know all company policies. Make sure to get HR approval before attempting it. By the way, is your visa stamp up to date? I know couple folks stuck in India for it for more than 6 months now. Dont get yourself into a situation like that where you won't be able to enter when really needed.
All sorts of issues with residency requirements. It's complicated.
Talk to your HR. Your manager cant override hr's decision if they later decide to terminate you for working from India.
The HR is fine.. I'm just concerned about US immigration and the Visa itself. Can someone stay comfortably for a few months outside US given that the team and HR are cool with it?
See responses above. You need a valid visa stamp or need to time your visit such that a consulate in India will give you a stamping appointment. Those are hard to get - Mumbai was offering March 2021 and nothing earlier than that , about one month ago.
Yah my stamp is valid for the next two years. (So seems that there's no potential problem).

So if I'm in India for less than 183 days, say for 3 months, then I'm still a US resident and do not owe any Indian taxes. I just get my US salary (after the normal tax deductions).
