My friend started on H1B, moved out of the US, came back and got a GC through EB1, gave up the GC as they had to move out of US and now plans to move back to the US. Can they use their H1B to move back without going through lottery ? Sequence of events and approx timeline below for easier reading: 1. Approved H1B - 2016 2. Approved EB2 i140 - 2017 3. Moved to Canada - early 2018 4. Moved back to US - mid 2019 5. Approved EB1 i140 - early 2021 (used EB2 priority date as EB1 had retrogressed) 6. Got GC - mid 2021 7. Moved to India for family reasons - early 2022 8. GC revoked - mid 2023 9. Plans to move back to US - mid 2024 #h1b #workvisa
