Equal opportunity to employ implies no discrimination based on race, sex, etc and not visa status.
The law gives companies the right to prefer American citizens over H1B. Equal opportunity is for sex, minorities religious beliefs etc. If you are not citizen that law has nothing to do with you. They do it bec H1B is a hassle for HR to deal and most people that ended up at HR don’t want to do paper work.
