I personally know someone who paid $$ to get a consultant file for H1B. They got their H1B and settled happily in US. Life is not fair ! US visa process sucks. Indians are street smart

😂 Jailed in the US is a bit of an overreaction. They should definitely get banned for abusing the system, while at the same time USCIS should fix the gray area of abusing the system and create a hard rule on the number of lotteries one can file for.

This is true. They are blacklisting these bodyshops and banning people from getting US work visas during the next stamping. My friend's roommate hasn't been able to go home for his next stamping just because he had a link to the blacklisted company initially before he got a real job.
These will be few and far in between. USCIS will keep collecting fees and throwing people under the bus. How difficult is it to make the passport a primary key.
Making the passport a primary key might not be very difficult. But what do you do with the existing data where the passport is not the primary key is going to be a problem. The best thing to do would be to say that the last entry is the one that is going to be accepted.
Or use SSN? You definitely have an SSN if you have a job right?

Body shop entity files H1B… sells candidates with approved app to other legal entities
The H1B is a work visa to allow for foreign nationals to work in specialty occupation, sponsored by a U.S. company - i.e. there is an identified need for a foreign national (usually they cannot find a qualified and willing US citizen or PR) to fill a specific role and scope. Companies typically sponsor an employee only after they have accepted an employment offer. Most H1Bs are subject to a yearly quota and are selected by random draw (hence being referred to as a lottery). 1 sponsor = 1 draw. The fraud here is there are some “consultancy” companies sponsor contractor/temp type roles, where there is no scope until another company hires that consultancy for bodies to fill some nebulous need. These companies are willing to sponsor regardless on if the candidate will accept their offer and also charge a fee to the candidate for filing (strictly illegal). Candidates who choose to go this consultancy path can be sponsored by multiple consultancies (as well as a 1 legitimate employer), leading to multiple draws. If one candidate has multiple draws selected, they will need to choose 1 and the rest do not go to anyone else. Scam comes from the consultancies, demand for the scam comes from lack of ethics from the participating candidates.

For all those wishing the worst on the folks who game the system, know that they are doing so because it can be done. Where is your anger towards WITCH/Big4 companies and USCIS who make this possible in the first place? I don’t see any repercussions for the companies or policy makers who allowed this stupid lottery system to thrive. This seems a lot like entrapment to screw the little guy, while the USCIS cashes the checks and WITCH companies keep the game going. Don’t hate the player, hate the game!
This is the reason I think the Reddit post is a made up story. Why would someone reject for visa because that company put their name? That person can just claim that the company told him that there is a client project ready once he joins and decided to put name in the lottery meanwhile.
I think it's completely possible. I know lady whose H1b got revoked and she's getting deported. Even her collegeues in that consultancy have gotten their h1b revoked. By the way she got her h1b in 2022
More than one story like this floating around. The other one was about a Big4 H1b candidate that submitted like 7+ applications. I hope it’s true.
