My new employer is saying NO to release official offer until 180 days from i140 approved are completed. She said they will start the offer letter exchange, h1b transfer process only after 180 days are completed. But she confirmed verbally that we are offering you this role, this compensation. But nothing on papers. Still i have 65 days more to complete 180 days.. Did it happened with anyone else. They took all the interviews, negotiations and just before sending the official offer, they said their immigration team said , i have to complete 180days after i140 approval in my current company. I was actually planning to get the H1B transfer done and get the joining date ..pending 65 days + 1 week of notice period..

Wait for 65 days. This is for your own good. If you are closer to 6 yr on H1 mark then this is a must do.

there is a rule that your current employer can withdraw the i-140 before 180 days affecting your priority date and h1 if it was based on that. my consulting attorney advised me the same thing as after 180 days the employer's action dnt matter and your i140 approval stays intact.
