Hi guys, I got laid off 2 months ago and just got two offers. My situation is that I only have 2 years out of 6 years left on my h1b visa and my top priority is job security and get my perm and i140 approved in the next two years in order to extend my stay in the US. Offer 1: A local company in traditional industry. Full time position. TC 95k. They offer day 1 green card sponsorship after I brought up offer 2. But less than 10% employees at the company need immigration support. Offer 2: A large tech company. One-year contract position through Kforce. TC is about 160k after annualized. Day 1 green card sponsorship through staffing company. The staffing company did mention about potential to extend the contract and convert to full time employee but it remains unknown until 9 months into the contract… Any one has any advice? Also, if any one has experience with Kforce I would greatly appreciate it too!!!! Huge thanks!!!
Option 2 or find option 3 meanwhile doing option 2. Don't stop interviewing. 1. Has low pay and small company has not much guarantee on how much they'll follow through
Thanks for the insight 🙏 that’s my concern about option 1 as well. It’s a safer long term position but not sure how fast or slow their immigration support is
This is a tough position, only because offer 1 is too low TC. The problem with offer 2 is that it’s a one year contract only, and Perm to i-140 is a long process. What if you have a pending i-140 and they decided not to extend? I am leaning towards offer 1 from stability of applying for green card, but try to negotiate higher TC! If I am in your position, I will chase stability and not TC till you get your approved i-140
Thanks for the insight! Really appreciate! That’s exactly my struggle and concerns now. Offer 1 has 95k base + 15% bonus but still way lower than Offer 2. For offer 2, it is with staffing company and they said they will help me find next employer/project before the end of the contract and they will try everything to get my perm and 140 approved. ( but I really don’t know)
Yeah the problem is that Perm process in itself takes a minimum of 10 months from start to approval, and may take longer! And if they chabged your contract and moved you to another employer, you might have to repeat the whole process again, because it’s tied to a specific job. Maybe since you work for the staffing company they can stick to the same job description and move on with no impact on your application, but I feel it’s a higher risk I don’t know how trusted staffing companies are, so hopefully someone else can give you more insights too
you need to decide based on the fact that it takes ~2 years to get i140 approved + extra 6 months to make it irrevocable. wherever you join you have to stick it out there irrespective of pip or layoffs or bad stock performance etc. otherwise the timeline resets. this is based on some of the suggestions made to join somewhere and continue interviewing. you are in a hard spot. please consider the above in your decision. another piece of advice is that if your i140 process has already started you can get 1 year extension etc. to complete the process. don’t want to scare you. merely stating how it is. wishing you all the best.
Thanks!!! Really appreciate your insight 🙏 that’s really a hard decision for me. Perm used to be super quick but now it’s the biggest concern for h1b holder.
Offer 1 if 140 is your top priority as long as $95K is a high enough salary to qualify for perm. Too much instability with Offer 2
Thanks for the insight! How can I know if 95k could be enough for perm?
You are a skilled person, why would you take an offer below living wage. GC is very uncertain and benefits of a GC are also very uncertain. You would get a comparable TC in india and PPP wise its a much better deal. Why do you want to stick around if they are letting you know you are unwanted here. Even a unskilled employee gets paid better wages. You guys are hurting yourself also the citizens here.
Would you consider SAP? Happy to help - DM and others as well, if needed. :-)
Option 1 no question. In fact I would ask company 1 a written email stating that they would start perm right away. Perm alone took me a year. The longest part is prevailing wage. Hopefully you don’t get audited as well. That will add 3 to 4 months. Proceed with option 1 - no question. Lately I have been meditating and my clarity of thought is on point - you are welcome.
Why option 1? Any particular reason? My concern about option 1 is 1)the company only has less than 10 immigrants need visa sponsorship so the lawyer might not have experience. Heard staffing company has more professional immigration service. 2)the wage is low and it might cause problems to PERM approval
To be honest, both are bad for long term. Just take anyone but keep interviewing for 6 months
okay. Yeah I agree. But it’s really hard to have better options in such tough job market now. Most companies can’t do day 1 green card and hiring freeze will affect perm process. option 1 and 2 idk which one is slightly better😂
