H1B to GC filing process (marriage based)
I am on H1B visa right now. Still waiting for perm approval (for I140). Perm was filed in march 2023 via Fragomen. This is my final year of H1B. (6yrs end in Sept 2024) I got married in Jan this year to a Green card holder. Told fragomen abbout it. They said we will file H1B extension and form i130. Has anyone applied for iI30 recently based on marriage based gc spouse? What is the process like? Current wait times?
Process is simple, basically itโs your spouse who is applying for i-130 and you also need i-130A. And then just wait until your priority date comes before you file for i485. In mean time if your spouse gets US citizenship, then update and immediately file i485 immediately. Check on /immigration or /USCIS on Reddit there are plenty of people daily posts about these.
