H1 -> H4 -> H1

I have an approved I140 and am nearing the end of the 60-day grace period. Has anyone moved from h1 to h4, and once you found a job, moved back to h1 without the lottery (with an approved i140)? I am wondering if I should do this or find a connecting position before the 60-day Grace period. PS I have an approved i140. I consulted an attorney, and they said I can do h4 to h1 with no issues. But I wonder if the companies are willing to do this and if it will affect my chances for interviewing..

OP, if your spouse has an approved I140 then it is an easy process. I have done this in the past. Convert to H4 and apply for H4 EAD in parallel. All companies I talked to at the time were willing to start employment on H4 EAD and convert to H1B while working there. It's a straightforward process since you are cap exempt. Also it is better to move to H4 now so you don't risk being in "out of status " state

My spouse is yet to get his I140 so I don't have the EAD option :(

I see. I don't have experience with that but I'd assume it is ok as you are still cap exempt. Suggest speaking to an immigration lawyer
