From their actions today, there isn’t one. Previous rounds of lay-offs, impacted employees received 1 week pay per year of service. This round they are citing low performance for a large portion of impacted employees (even when not true) to get out of paying any severance.

Oh, but I know folks who received 3% pay increment but still got laid off. I wonder how they can justify that under performance? I really hope they file a lawsuit because not paying severance is just straight up wrong considering the company is profitable. In addition, they had no issues assigning equity to all the higher ups, so paying severance is only fair.

FYI It sucks about the layoffs but lawsuits aren't applicable since there are no requirements mandating employers to pay severance under the Fair Labor Standards Act. Performance doesn't matter since Washington state where Nordstroms is based is an at will employment state which means they can terminate employees anytime for any reason.

But if they are gonna terminate, then they need to provide a 60 day notice to WARN. That hasn’t happened. What’s the justification for that?

I haven't seen the Nordstroms numbers. Have they released the impacted numbers yet? Warn notice requirements considers mass layoff a reduction in force that results in job loss at a single employment site if the number of employees laid off makes up at least one third of the employer's active workforce, or for at least 500 employees. But many employers will still report if the numbers are close to 499 or if they think there could be more close behind.

Nordstrom was such a shit show... They give the same reason to most of the employees... "Laid off because of poor performance" just to escape from providing severance... This is so cheap for a company like Nordstrom. They have no way of providing evidence to site poor performance. The leadership folks suck big time. Would recommend not to join such an unethical company.

All the layoffs were decided based on who wouldn’t get severance pay. Employees that have been there around a year or less and employees who had any negative performance review. When I asked in my skip level lay off meeting if this was performance based she said no. I asked if this is bc I was the newest one on the team (14 months) she said that had something to do with it and then said she couldn’t answer anymore questions. Everyone I’ve spoken with was either new to the company, had recently taken a new position, or had a semi-negative review for one BS reason or another in the past year. This was all done to avoid severance packages. Even though they set aside $400M for the Canadian layoffs and shut down. So they got severance but we get screwed. Nordstrom leadership are greasy Fu@ks who lie in all hands meetings and then when they have to make cuts leave you with absolutely nothing! No money to get to your next job. I’m going to have ti cash out my 401k if I don’t find something within the next month and a half. Mortgage, car payments, kids and one with medical issues. These ppl are heartless. And how the F are they getting around the WARN act? This is a federal law. 60 days notice or 60 days pay for those laid off. Also, I haven’t heard a single thing from my direct manager. Not a word. Which is REALLY strange. Anyone else also not heard from their managers? Only skip level spoke with me.

My heart is burning Everytime I get reminded that there is no severence after working my ass off for many many years. I knew people who worked more than 10 years and still paid 0 severence. I downloaded all my quarterly connects and even the last one says "we were lucky to have me" I couldn't speak back when I was said I would be paid "zero severence because of my performance" as I am still in shock. It was too late until i realized the reality and the reason they gave for performance is hurting me everyday (why not accept the fact that they don't have money?) Even last week's 1:1 my manager said I am doing everything perfect. Never felt backstabbed like this by anyone in my life.. didn't expect that it would come from Nordstrom. Life sucks for people on Visa like me as they just gave 2 weeks notice instead of 60 days like all other companies give. Everyone i talked to was in shock when they hear just 2 weeks notice and no severance.. Kicked out with zero bonus, no hike, no severance and just 2 weeks notice even without any red flags on performance

When they said that, they told due to the current economy most people across Nordstrom didn't get any hike (discussion happened in March) and pay rise was given only to people who "exceeded" expectations. I am given 56% as my performance range at my level and I think that's a mid range but not poor performance. Not even in one discussion i was said I am performing "poorly". If not getting a hike means i am performing poorly I certainly missed something.. For context my precious manager told i am already performing at next level and my current one told everything is good just last week

UPDATE for anyone reading along. Nordstrom changed their stance and 8 days after laying so many people off without severance, decided the people let go were in fact going to earn severance. This round of layoffs was a disaster, but glad it ended in a better place.

I do not understand how such a company could make a mistake like that. This is the latest of severally layoff rounds over the last year, who came up with such a bright idea to save a buck??
