Drug maker Purdue has plead guilty in court for its role in the Oxy epidemic it caused. Turns out that they were executing on a plan developed by McKinsey to "turbocharge" sales of Oxy. To get pharmacies to sell even more oxy this plan included a proposal from McKinsey to rebate pharmacies for every patient who died of an overdose. Wouldn't McKinsey be protected under indemnity insurance?
From civil liability up to the limits on their policy (they are still liable but presumably if they have such a policy their insurer will pay). Liabilities in this case run into the billions so they would need to pay anything above their insurance coverage. From criminal liabilities - I don't think you can insure against that, and criminal activity might invalidate the civil insurance. It is unclear whether charges will be brought. So far only Purdue has been charged, but it does look like McKinsey is complicit.
