Leave a tip to USCIS. Tell them that the employer is exploiting the emoloyee. It is for companies like this that H1B program gets a bad reputation sometimes.
Yeah, and then USCIS will review his friends visa as well which may prevent them from transferring. Talk about shooting yourself in the leg.
Name the freaking employer here and then see them collapse for their employee exploitation policies... there is no reason for them to be in business
I have seen many companies do it. In my previous company they made me sign it, i did sign it, when I left, they did not bother to check it. Not saying the other company won’t. I would say play along, in this environment if someone asked me to pay for H1B myself, I would. After all they are willing to file for you, bet on you, shouldn’t you?
This is not legal and is simply a scare tactic. Your friend should collect written communication about it, agree to pay back, and then go ahead with the job. If the employer ever tries to enforce this contract, they can write in to ReportH1BAbuse@uscis.dhs.gov. It's not legal for employee to pay for LCA or PERM. For all other visa or immigration charges, it's completely legal.
It's perfectly legal to pay for all immigration fees except LCA (H1B) and PERM (Green Card)
How sure are you about this? Can you please share a few online resources? Per my research both the filing fees and the legal fees are to be paid by the company and not the candidate.

Contact an immigration lawyer. Since it's illegal for employers to ask employees to pay H1B fees, I suppose this would be illegal as well.
Thanks for the suggestion. I read that the employer can file “damages” if the employee leaves before certain period. Not sure if damages=h1b expenses.
