I’m on H1B with I-140 approved. I’ve a new job offer from Home Depot now. The offer is good, but the recruiter is saying that Home Depot won’t initiate my Perm or i140 for the first 12 months. Is this normal and part of company policy? Can I try to forcefully negotiate this? Would this be risky for my future?
It’s normal. Many companies (old school corp world, finance, manufacturing,cpg) have similar policies. Even older tech firms can be like that. FAANG is it’s separate bubble. Ie I did not really care about GC when looking for a job with H1b as I had 5+ years to apply and am not from a backlog country. So it was a bonus by not the main factor. Decide what’s important for you in a long run.
It is candidates market. Negotiate with them and they will agree with Your requirement if the team likes you.
I won’t buy that ....because even though your PERM date is retained the whole process needs to be done again. So a 12 month gap in starting the process introduces a very long delay in the whole process. I say play hard ball.....
Tell them that you won’t join unless they’re willing to do the PERM process immediately.

Yes... that’s normal... anyways you have I140 approved already .. there is no need to file immediately ... I joined in July 2018 and they said they would do it in 12 months and recently they have mailed asking for the paper work for PERM... so nothing to worry at all ... most of the companies have the same policy ...
I’m on a work visa too, and my rule is that any company that plays hardball with immigration paperwork like this doesn’t really care about me as an employee, and I don’t work for them.
Makes sense, mate. Their commentary is - ‘big company, company policy’ etc. The opportunity is good. Technology is good. Hence I’m on the fence.
My life and stability outside of work is more important than the tech. Plus if you’re good, you’re going to find tons of opportunities with companies that care about you, so why compromise?
