H1B application

eBay ghbayil
Feb 7

Hi,

I am a grad student graduating this May. I currently have an offer from a company which I don't want to join (I am still looking for better opportunities), this Company can apply for H1B this time but since I am not sure if I will be joining I do not want to. If I get some offer by mid March is it possible to apply for H1B this time?

You can’t apply for H-1B this year unless you have your degree in hand before April 1st. Unless your university can provide a letter stating you have completed your requirements/your degree, they won’t file it.

Source: was told this a week ago by the immigration team of the company I will be working for when they realized I would only graduate in May.

But I think you can apply with your undergrad degree

That's correct. You can't apply in masters quota. But can still apply in general pool.

@catburglar ? This is what BAL lawyers told me hehe they’re the ones Google contracts out to do our immigration paperwork

@ghbayil correct, if you already have at least a Bachelor’s then you’re good

@OP I misread your post and didn’t notice you’re a grad student. Carry on 😅

      @paypal: EB3 is for GC not H1B.

Also after 10 years EB3 gets converted to EB2.. and if you are Indian you are anyway not getting your GC for next 10 years at the current pace. So should be fine.

My friend's company applied for h1b and it got approved even before he graduated from masters. Not sure about masters quota though

I’m the living proof that you can apply for masters quota H1B if you don’t graduate by the time you file. However, you should graduate before Oct 1 and your school should provide documentation saying you have completed all coursework and just waiting for graduation. Talk to your attorney in detail.

  • Accept the offer. Let them file H-1B. If it gets picked up, join them. You can always change jobs later. One more H-1b chance is more precious

Most companies have 15th March as a deadline for accepting the offer if you want them to file for H1B this year. This is not a rule though.

If you are international, many of the options are unfortunately closed for you man

This isn't true at all. Source: am 'international' and have 'international' siblings getting into the job market here just fine.

Bruh. Take it easy. Im international too. Just saying this for the expected job offers in the current market, man. I just adviced him to take the safest option right now. He may score a better offer. But thats a risk he would be taking.

I think many of the options are close to being closed for everyone at this point, not just “internationals”. Shit just fills up at some point lol at least for recent graduates

Thanks everyone. I will accept the offer if I don't get anything by next week and try for h1 this time.

You need atleast 3 pay stubs before they file you H1 application in April. So it's good time to join ASAP
    Feb 81
    • Not true. Pay stubs are not required for filing an H1 application. H1b is for prospective employment.

It just makes the case stronger if you have been working for the same company in some other status. To prove that, you provide pay stubs

If you don't get another offer this week or something, I would recommend taking the one you already have. As others have mentioned, you can always change jobs later to a 'better' company if you want to. But you will sacrifice this attempt at the H1B lottery if you don't take this.
