Length of break between 2 jobs on H1B

Found a new job and waiting for H1B transfer . Looks like it will take 1 more month at least ( without RFE that is ) . If I get one it might take much longer . What’s the longest I can take between jobs , practically . I know there is a 60 day rule where you can be unemployed on H1B . But wanted to check if there was a way I could quit sooner ( can’t take my job/team anymore )

No. if I recall correctly technically the max time is zero days but under (is it 60 now?) days the limit isn’t enforced. Can you take vacation now?

I submitted docs today for premium processing but the immigration team says they will take two weeks to prepare the documents. And 2 weeks for premium processing

It will be one month on an average. Two weeks for lca and two weeks for confirmation. Offorse it can be faster as well

I am in same boat, I submitted my documents on 31st July. I checked with the immigration team today and they said they are waiting on LCA certification which they expect to receive any day and then they will file for transfer. So I am taking 2 weeks off starting next week and upon arrival I am planning to give 2 weeks notice

According to my lawyers - you can typically have a maximum break of 2 weeks between jobs if you are within the country. If you want a break of more than 2 weeks, you can travel outside provided you receive the physical copy of I797 A with the name of the new employer. This can be used at reentry along with your job offer.

Correct me here, but don't you have to do H1B stamping again with new employer if you leave the country?

No as long as visa is valid and you have new paperwork on hand. My stamp is still with my previous company but I traveled abroad a few times

Transunion i have done that. Its fine as long as u have new i797. Current employer valid visa stamp is sufficient with new i797

Visa stamp is valid but employer is a previous one. Not current and not future employer.

I think that is sufficient to re-enter us as long as its valid but u need new i797.

Doesn’t matter. Do as you like. If your new company is good they will take care of immigration things themselves.
