Multiple offer and H1B
Have offer from vmware and H1B transfer in the process (got the receipt but waiting for approval) Now expecting another offer from Apple. Now the question is if i accept apple offer and start the H1B transfer then 1. How to handle the situation with no risk to H1B visa issues and all 2. Is it good idea to join vmware and then leave as soon as apple H1B transfer is done. Does not like to join vmware for 1 month but at the same time looking for H1B security. TOC - 230k Please Help.
If u were last employed at VM then Apple must transfer from VM. If not from ur current company. when u join VM, ur current company will automatically cancel your Visa with them
Thanks for helping. So at the time of filing the transfer it will check the current employer. Got it. So is it good idea to join Vmware and then go to Apple? Or just stop Vmware processing and do it only for Apple. Which is the secure option ?
That I have no idea. From a legal standpoint I dont think it matters as much as it does from an ethical standpoint.
I am in the same boat , Emp A a body shop has filed for extension and extension is approved , before this approval , Emp B FTE has filed a transfer and is approved too , can I join Emp B?

Better to join VM and then Apple. Better be safe if h1 transfer at Apple gets prolonged for any reason. Also before the transfer process companies might do background check, references, drug test etc. h1 transfer can also have rejections at times.

You can have multiple petitions to your name, due to H1B portability rule, VMware will do the necessary paperwork to withdraw unless they want to remain legally obliged to pay you.
Thanks for you response. So if I join Vmware, Apple should file the transfer from Dell or Vmware. I have approved i140 from Dell.
Visa is never transferred. Apple will file a new petition. It will be cap exempt.
