Non-Compete Questions.

I'm currently at a client location with Infosys and recently a recruiter reached out, from the same client, for roles open at the exact location I'm currently at. I want to pursue this but my non-compete prohibits this. So what should I do? Poll below. Location is not in a state where non-competes are illegal. TC:65k YOE:3

They’re not gonna go for noncompete for low level it guy. Non competes are mostly for director level people.

Yea, there’s a reason it’s low. Got desperate after a failed startup left me $20k in credit card debt. Also, I’m paying about half the rent I would be in SV, so it’s not too bad. Got a phone interview at Google in 2 weeks and an online assessment at Amazon due by next Wednesday. So I’ll see how that goes. My non-compete doesn’t interfere with those at least.

Screw the non-compete. It's not worth the company's time to go after you. I'd go for the job and check out the offer. Do you, and do you right!

I am also in exact situation I left infosys 6 month back and now applied to the same client in same location. Client asked me to get non compete waiever letter. But infosys told they can’t give me such letter so, no option then trying after extra 6 month.

Speak with a contact attorney. Google work non-compete attorney in your area. Fee is about 300-500 for basic work contract reviews. Non-compete for low level employees are very unlikely to be enforceable, however, this is not a legal advice and I am not a lawyer. If you mention non-compete clause to recruiters, they will probably move on. They don't have time to spend for such things unless you are the only guy for the position.

Y'all would think non-compete doesnt matter, for a low level employee, it actually does in the consulting world. It's really not about TC of that person, the consulting firm might have quoted him for much higer hourly price, and they'd definetly try to be PIA. It does depend on the manager too !

You'd think, but mostly the non-compete and damage mitigation plan listed on the contract are mostly the scare tactics. Speak with an attorney if you are stuck in so-called "consulting" jobs because of non compete. Btw, i am not a lawyer and this is not a legal advice. But you all should seek a real advice from attorneys. My friend spoke with one and he got out of 3 year slave-like contract without paying a penny for the penalty.

Good luck! I've had soooo many recruiters reach out to recruit me for the client, but all of them bailed/cancelled interviews once they found out about my two year non-compete. I was told there was no way around it. However, for me, the customer can "buy" my contract after two years, but that's also more then enough time to find something better if you're actively job searching. When I quit, HR resent that two year non-compete to me as a reminder.

It they try to enforce it, judges are known for throwing them out as they harm the employee.

Company doesn't give waiver letter but as said they don't say anything. My own colleague joined different employer for same project and client. My employer didn't objected even though there is non-compete
