Will there be any problem if I don't include it? Personally I wouldn’t list it. If you are asked about it don’t lie though.
Asked how? How would they know? If they ask you throughout the interview process what you are currently doing at company X but you work at company Y do you just play along and say you’re still at X?
Asked about the time gap retrospectively. OP said they were still at the first employer while interviewing for the third so that situation isn’t accurate. If they asked after he started at employer 2, I would tell the truth even if it’s not listed on my resume.

I once had to excuse myself from an interview loop since the candidate briefly worked in my team at a previous company, and didn’t list it. They eventually got the job, but the number of times I had to speak to recruiters and hiring managers on his behalf was insane. How many times can you say “We had 120% turnover in 6 months. He started at month three of that, looked at the disaster and left. Good on him for recognizing it and going with his second choice.”? 8 times. “So, you recommend hiring him?” “I recommend not holding the fact that he didn’t mention it against him, but I didn’t work with him long enough to recommend him. But he read the situation there right.” He outlasted me at that second job, btw.

I think your resume should have only things you want to discuss that show you in a positive light. However, I think a background check should have all of it.
Yea I'm not worried about the resume and I won't list it there. My concern is the background check.
If you are really curious, ask the company hiring you and the background check company what to put down, and if you need to out down all jobs or not.
