Hey Anyone here used AC21 to change jobs? I have a new job offer And I want to port my pending I-485 (I-140 is approved, I-485 should be approved within a month from now). I am on L1 visa now. As I have an EAD already, do I need to file Sup J before joining new employer and await response or can I start and file ASAP? No issues with same or similar as it’s identical job in tech just a lot more money.
It’s an easy, admin task. I think PD needs to be current. Sup J should be filed shortly after joining the new company (1-4 days). The reason for switching should also be compelling (lay off, reorg, etc) or the question of intent comes up in the interview. When you do switch, L1 is invalid and you should not travel out of the country until you have GC in hand.
Ok thanks for that. Re your comment about intent my interview is already complete. Somehow I interviewed while PD was not current so finished everything and just awaiting the green card production and final approval which can’t be done until (anytime from tomorrow) PD is current. Do you still think ‘intent’ is an issue as I’m moving simply for a major raise and promotion. Does filing sup j delay anything at this stage?
Thank you. You are quite knowledgable about this stuff. It is actually quite similar to what you have said in that my role has in fact changed from what was agreed. That last part is important because because it would be quite likely that it gets approved before I start.
I understand but my lawyer is paid by my company and I don’t want to tell them I might leave. It seems the best thing is to file sup j. That’s ok with me. If somehow the GC is approved while my sup j is pending (crosses in the mail etc) then at least I have proof I complied.

Is your 140 approved for more than 180 days? What about 485 - has it been filed for more than 180 days?
Yes both are. I-140 is approved long ago and I-485 has been filed 9 months ago and PD is actually current in January. Do you have any advice for my question?
