I accepted offer from a competitor but haven’t decided when to leave MS yet. Attorney from new company confirmed i am eligible to move without hurting GC interview, as long as I bring the new supplement J form to my interview. I want to get out of MS asap. Questions for folks: 1. How long does it take to file a new 485J form? Would bringing a new J form to interview slow down my green card approval process? 2. If i stick with MS until i am done with the interview but switch right after, do I need to bring up my intention to switch during the interview since I have accepted offer? Will I get trouble for not disclosing it? thanks a lot!
No reason to wait for 6 months after you your GC. That's a myth. About 485, you should be talking to your lawyer not some random person on blind.
It doesn’t really matter what you do, either option is legal and perfectly fine. If you want to leave MS, then leave. Either way you need updated letter to say still employed, last 2 months pay stabs, last W2 etc If you stay at MS, until the interview, you’ll likely get approved for GC in the interview and get a card the week later If you change jobs, you’ll still need the above proof anyway. The I485 Supplement J form is dead simple to fill it, you don’t need a lawyer. If you had the MS lawyer when you applied, and quit MS before interview, you’ll need to update the G28 form. Again very simple.
Thank you for the reply. I got enough clarification from the attorney and decided to switch companies right before my GC interview. The downside is I would get GC a few months later but I think it is worth it cuz I just want to quit from my current team/manager ASAP and start working on something meaningful. Gonna leave next Monday.
@nVuB20 - so does the new employer file 485J ? Was 485J part of your original package when u initiated AOS with MS ? What is the timeline for new employer to file 485J ? If it’s big company they do things in batch system , does that hurt your chances of GC / issue during GC interview ? Thanks
I’m in a similar boat, though I’ve had my interview. If I change jobs on my EAD now, should I send in supplement J? Or wait for that to be asked for? We are just waiting for my PD to become current (recently retrogressed). I know the roles and comp is supposed to be similar. Would a GC be rejected if there’s a comp increase? How similar / identical are the roles supposed to be? My new one would be technically a step up but still in the same realm (business side of Tech). Leaving my current employer will cause me to lose my L1 visa and I’ll only have EAD as a valid means of working. Want to minimize the risk that my GC would be rejected.

I decided to stay put - especially in current situation. Decided I’ll wait for GC to come through.
Get GC in hand and wait at least 6 months after that. Talk to immigration attorney.

This 6 months after getting GC is unfounded. I had a consultation with an independent immigration attorney who said “if you can legally transfer via AC21 with an unapproved I-485, why should it make a difference if you transfer after it’s approved?’. This logic makes sense to me - why should it be fine before approval and not fine after.
