Congress does have that power, and they used it to pass the Clean Air Act decades ago. Which the EPA enforces. This is really getting ridiculous. I understand there are different opinions and interpretations of the laws, but at this point SCOTUS doesnât fucking care anymore.

Congress canât create a law that allows a non-elected body to then make new âregulationsâ with the power of law because Congress said it was totally cool. Only Congress can pass laws in the US, thatâs why we have not had a king or dictator in going on 250 years.

^this. Courts only enforce laws. Instead of sitting on their asses where this is ambiguity or reliance of precedence, codify what you want into law. Thatâs what congresspeople are paid to do.
Congressional dems have tried two times this year alone to codify abortion rights, GOP has blocked both, and then for some reason democrats get the blame.

There is going to be a civil war at some point. Both the Senate and SCOTUS need fixing.
Just because you donât get your way doesnât mean something needs fixing. We should all agree to follow the constitution and lawmakers should work together to pass bills to help people and practice oversight to limit corruption.
The filibuster isnât in the constitution. Neither is the Supreme Court having 9 justices, or even having the power of constitutional review.
