Currently I'm working in US with valid H1B visa, and plan to file for 140 very soon. After that I intend to leave US for a few years and come back afterwards. However, after 140 approval, I'm afraid I'll not be able to travel back to US by applying for B1 visa, since 140 approval indicates I have an immigrantion intent. A workaround that I think of is: I can leave US to apply for B1 visa first before filing for 140, while still having valid H1B visa. After B1 approval, I can come back to US with H1B visa and apply for 140. My questions: 1. How likely will I get B1 visa in this case? What if the interviewer question why I apply for B1 while still on H1B? 2. Any chance the interviewer will cancel my H1B visa if got the B1 visa approved? Thanks!
