Hi. Has anyone applied for GC while on F1/OPT here? Without applying for H1B, I mean. If so, how was the overall process different than applying for GC while on H1B? did you have to pay the fee yourself or did your employer pay it? I'll appreciate any advice on the process #greencard #immigration
Can we apply for GC on f1? Isn’t this a change of intent? F1 isn’t supposed to be permanent immigration visa. I thought GC gets cancelled on f1.
Yes change of intent, but there is no law prohibits it as such. Intent is only when you get the visa, you can change your intent while on f1. Its upto cis if they accept your change of status
It’s a bit playing with fire. H-1B is a dual intent visa. F-1 is not. They may deny any additional F-1 requests such as a new stamp or OPT based on your then known intent to immigrate.
H-1B is not the only way to get a green card, but it’s the most common one for employment-based route. If the company can prove that you are an extraordinary person, they can file an Employment First Preference (E1) visa directly, because there’s virtually no waiting line. The catch is that the visa is available only to persons with extraordinary ability, outstanding professors and researchers, and multinational managers or executives. If you’re not a professor or a multinational executive, you better be a genius who has won all sorts of contests and awards. Most people don’t qualify, that’s why they wait in line as an H-1B.
Is that the EB1 category that you're talking about? If so, then I think I'll come under the EB2 category (since I have a master's degree). I'm trying this route because I think the queue for GC application will be shorter in my case.
It’s similar to Canadians who apply for GC while on TN status. You need to make sure you have enough time left on your F1/OPT because filing i485 is immigration intent. You want to have legal status to stay in the US until you get GC after i485.
There is debate whether it's safe to apply gc on opt or not but I've done it and got 140 approved on opt. Plus traveled during that time too with no issues. Whether I got lucky, i don't know.

I know bunch of ppl at amazon who did it (all PMs), born either USSR or Western Europe. Most got their Gc under a year being F-1. Amazon would also apply h1b while proceeding GC
Yes. Got it without ever getting H-1B. It is just a normal process. You can apply for GC and H-1B in parallel and if you get both H-1B gets cancelled automatically
