I have been in discussions with another company and they have given me an offer and they are willing to sponsor with visa. My current employer is sponsoring me with an E-2 visa and they really want me to stay for the long run. I don't hate my current job and would stay if my deal was better. At what point should I bring this up and ask if they can offer me to stay? The visa thing puts me in a tough spot! I don't want to bring it up with my current employer until I can confidently resign if they can't offer a counter.
I hear that this usually doesn’t go well. Your employer might start de-prioritizing you because they think you’re shopping around for other jobs.
Hmm... this sounds familiar. I feel my employer has caught on to me wanting to leave and that I might be managed out. Do you know of anyone this has happened to?
If you’re able to immediately switch jobs, I’m not sure why you wouldn’t do this. I’d suggest being careful to not burn any bridges, but other than that have at it.
If you decide to counter, just be ready to leave......
I was almost in the same situation a few weeks ago. I received an offer (28% base increase) and really wanted to negotiate with my current employer, but decided not to for fear of losing my visa or backing myself into a corner with the new employer. Have been in a similar spot a couple of times and have had to leave for a different job. Unfortunately on a visa I don’t think you can effectively do a counter offer till you have another offer in hand. I would always try to justify a pay increase by showing change in responsibility, results etc and I would wait for 6 months to a year. If nothing happens after I ask a couple of times, I interview to find out if my ask is legit. But the effort that it takes to find a new job on H1B visa these days, I am not looking for a new job to counter for my existing job - I am literally looking for my next job. So I would advise you to bring up the pay increase a few times and find a different job if it doesn’t happen. I’ve known too many people who have been kept in the same salary band for years because of visa and location constraints.
You are using counter offer to threaten your current employer, how could this possible go well??? Just take the offer and leave.

The work place is not bad and I live just next to the office. I am a crucial resource in our small office, but the company can't pay my worth and they can't afford replacing me either. So I want to negotiate to go down to 75% but keep the same pay, so I can spend the other 25% on studies. I know this all sounds weird, but the company isn't American and it's quite small.
